MYTHIFI is the trade name of Metamise LLC, a Washington limited liability company. We are a marketing systems company that builds Authority Conversion Systems for Property Professionals (contractors and the trades, real estate agents, and lenders), based in Washington State, United States. All services and consultations are delivered remotely unless otherwise arranged.

Use of This Website

Booking & Consultations

When you book a Pipeline Diagnosis call or any other consultation through this website, you agree to the following:

• Consultations are diagnostic in nature and do not constitute a binding services agreement.
• MYTHIFI reserves the right to decline or reschedule any consultation at its discretion.
• Information submitted via booking forms may be used to prepare for and conduct the consultation.
• No payment is required to book a Pipeline Diagnosis call. It is provided as a free diagnostic service.

No Guarantee of Results

Marketing outcomes depend on a wide range of factors beyond MYTHIFI's control, including market conditions, your business operations, and your implementation of recommendations. Except for The Impossible-to-Ignore Guarantee published on this website, which is offered on the terms set out in the signed services agreement for a given engagement, nothing on this website constitutes a guarantee of specific results. Any projections, estimates, or examples are illustrative only and are not promises of future performance. Where that published guarantee and these Terms conflict, the guarantee, as defined in the signed services agreement, controls.

For material changes, we will update the "Last Updated" date and post notice on this page before the change takes effect, and the change will apply prospectively only — it will not alter the terms governing any dispute that arose beforehand. Non-material changes take effect on posting. Your continued use of the website after a change takes effect constitutes acceptance of the revised Terms.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict-of-laws provisions.

Binding arbitration. For any dispute arising out of or relating to these Terms or your use of this website in which the amount in controversy is less than fifty thousand U.S. dollars ($50,000), you and Metamise LLC dba MYTHIFI agree to mandatory binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with the arbitration held in King County, Washington. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Court jurisdiction. For disputes in excess of $50,000 in amount in controversy, and for any action seeking injunctive or other equitable relief, the parties consent to the exclusive jurisdiction of the state and federal courts located in King County, Washington.

Mixed or threshold-straddling disputes. If a dispute includes both arbitrable and non-arbitrable claims, or if the amount in controversy is uncertain at the time of filing or could reasonably be expected to exceed $50,000, the dispute shall proceed in court under the preceding paragraph, and the arbitration provision above shall not apply to it.

Prevailing party. In any dispute arising under or in connection with these Terms, whether resolved by arbitration or in court, the prevailing party is entitled to recover its reasonable attorneys' fees, costs, and expenses from the non-prevailing party.

Relationship to Client Agreements

These Terms govern your use of this website. Where you and Metamise LLC dba MYTHIFI have entered into a signed services agreement, that agreement governs the services described in it, and its terms control over these Terms to the extent of any conflict for that engagement.

Eligibility

You must be at least 18 years old to use this website. If you use it on behalf of a business, you represent that you are authorised to bind that business to these Terms.

Your Submissions

Information you submit through booking forms, questionnaires, or communications may be used to schedule, prepare for, and deliver our services, as described in our Privacy Policy. We do not assume any obligation of confidentiality with respect to that information beyond what the Privacy Policy states or a signed agreement provides. Do not submit information you consider confidential without a written agreement in place.

Feedback

If you send us suggestions, ideas, or feedback about our services or this website, you grant us a perpetual, irrevocable, royalty-free, worldwide licence to use it without restriction or compensation.

Suspension and Refusal of Service

We may decline, suspend, or terminate access to this website or our consultations at our discretion, including where we believe these Terms have been violated.

Time Limit on Claims

Any claim arising out of or relating to these Terms or this website must be brought within one (1) year after the claim arose, or it is permanently barred, except where applicable law prohibits a shortened period.

Survival

The sections covering Intellectual Property, No Guarantee of Results, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, Time Limit on Claims, and Severability survive any termination of your use of this website.
